1. Accepting these terms
By using this website, requesting an estimate, or using the project assistant, you agree to these terms. If you do not agree with them, please do not use the site — call us on (916) 532-3015 instead and we will talk it through directly.
2. Licence disclosure
AJ Construction Inc holds California State Licence Board licence #1129358, classification B — General Building Contractor, and carries a $25,000 contractor's bond. The licence is active and its current status can be verified at any time on the CSLB website.
We only perform work that falls within our licence classification. Where a project needs a trade outside that classification, we engage an appropriately licensed specialist and tell you so.
3. This website is informational
Everything on this site — service descriptions, project photos, process explanations — is provided to help you understand what we do. None of it is an offer, a guarantee of a particular result, or a quotation for your specific property.
Project photographs show work completed by our crew. Conditions, materials, site access and code requirements vary from property to property, and a similar-looking project at your address may involve different work and a different price.
4. Estimates and bids
Site walkthroughs and written estimates are provided free of charge. An estimate is a proposal, not a contract. It becomes binding only when it is incorporated into a written contract signed by both you and AJ Construction Inc.
Unless the estimate says otherwise, it is valid for 30 days. Material prices move, and beyond that window we may need to re-price. We cannot give a firm price for work whose scope we have not been able to see — anything concealed behind a wall, under a floor or below grade is assessed once it is opened up, and any resulting change is presented to you for approval before it is carried out.
5. The construction contract governs
Your project is governed by the signed written contract between you and AJ Construction Inc, not by this website. That contract sets out the scope of work, the materials, the price, the payment schedule, the approximate start and completion dates, the change order process and the warranty. Where anything on this website differs from that contract, the contract controls.
California law requires home improvement contracts to be in writing and to contain specific terms and notices. We will not begin work on a home improvement project without that signed written contract in place.
6. Down payments and progress payments
For home improvement contracts, California law limits the down payment to $1,000 or 10% of the contract price, whichever is less, excluding finance charges. We comply with that limit. Any contractor asking a homeowner for more than that as a down payment on a home improvement contract is acting outside the law.
Payments after the down payment are tied to work actually completed or materials actually delivered, as set out in the payment schedule in your contract. We do not ask you to pay ahead of the work.
7. Your right to cancel
For contracts signed at your home or anywhere other than our place of business, you have the right to cancel within three business days of signing. If you are 65 years of age or older, that period is five business days. Your contract includes a written notice of cancellation form explaining exactly how to do it.
Separate and additional cancellation rights apply to contracts to repair or restore damage from a declared disaster. If that applies to your situation, we will tell you and the notice will be in your contract.
8. Permits and inspections
Where a permit is required, your contract states who obtains it. As a licensed contractor we will not perform permit-required work without the permit, and we will not ask you to pull an owner-builder permit so that the work can avoid our licence and our responsibility.
Inspection timing is set by the local building department and is outside our control. Delays caused by inspection scheduling, plan review or utility connections are not treated as our default.
9. Mechanics lien notice
Under California law, contractors, subcontractors, labourers and material suppliers who are not paid for work or materials supplied to your property have the right to record a mechanics lien against it. This applies to any construction project, with any contractor.
You may receive a Preliminary Notice from suppliers or sub-trades on your job. That is a routine legal step, not an accusation that anything is wrong. To protect yourself, you are entitled to ask us for unconditional lien releases from anyone who has sent you a preliminary notice before you make each payment, and we will provide them.
10. Project photography
We photograph our work — during construction and once finished — and may use those photographs on this website, on our social media, and in estimates for other customers. We photograph the work, not the people who live there, and we do not publish addresses, house numbers or anything else that identifies where a project is.
If you would rather we did not photograph your project, tell us before work starts, or at any point afterwards, and we will not — or we will remove images already published. There is no charge and it has no effect on your job.
11. Communications
When you submit your details through this website you are asking us to get in touch, and you consent to us contacting you about that enquiry by phone, text or email. Message and data rates may apply. You can ask us to stop at any time. How we handle the information itself is set out in our Privacy Policy.
The project assistant on this site collects your answers and passes them to our project manager. It is an intake tool. Nothing it says is an estimate, a price, a schedule commitment or professional advice about your property.
12. Website content and trade marks
The text, photographs, layout, logo and design of this site belong to AJ Construction Inc or are used with permission. You are welcome to view, print and share pages for your own purposes in evaluating or working with us. You may not republish our project photographs as your own work, or use our name or logo in a way that suggests we endorse or are connected with something we are not.
13. Third-party links and embeds
This site links to outside resources, including the CSLB licence lookup and our social media pages, and can embed video hosted by Facebook. We do not control those services and are not responsible for their content, availability or privacy practices. Embedded video does not load until you choose to play it.
14. Website disclaimer
This website is provided "as is". We work to keep it accurate and available, but we do not warrant that it will be uninterrupted, error-free, or that every detail is current at every moment.
This disclaimer is about the website only. It does not limit, reduce or disclaim any warranty on our construction work, which is set out in your signed contract and governed by California law.
15. Limitation of liability
To the fullest extent permitted by California law, AJ Construction Inc is not liable for indirect or consequential losses arising from your use of this website or from reliance on general information published on it.
Nothing in this section limits our liability for our construction work, for personal injury or death caused by negligence, for fraud, or for anything else that cannot be limited under California law. Your rights as a homeowner under the contract and under the Contractors State Licence Law are unaffected.
16. Complaints and the CSLB
If something about your project is not right, tell us first — call the owners on (916) 532-3015. Most issues are solved fastest by the people who did the work.
You also have the right to take a complaint to the state at any time. Contractors are required by law to be licensed and regulated by the Contractors State Licence Board, which has jurisdiction over complaints against contractors if the complaint is filed within four years of the date of the alleged violation. 17. Spanish-language negotiations
We do business in English and in Spanish. Under California Civil Code section 1632, where a contract is negotiated primarily in Spanish, you are entitled to a written translation of that contract in Spanish before you sign it. If we negotiate your project in Spanish, we will provide it. Ask us and it is yours — you do not need a reason.
18. Governing law
These terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute relating to this website will be brought in the state or federal courts serving El Dorado County, California. Disputes about construction work follow the dispute resolution provisions in your signed contract.
If any provision of these terms is found unenforceable, the rest remains in force.
19. Changes to these terms
We may update these terms. The "Last updated" date at the top of the page will change when we do. Continuing to use the site after an update means you accept it. Changes here never alter a contract you have already signed.
